Chemist: Order came from DG


A chemist said that she was tasked to work on this case beyond her usual hours.

The Anwar Ibrahim sodomy trial continues today with the cross-examination of the chemistry department's DNA paternernity unit head Nor Aidora Saedon.

azlanToday's cross-examination would be vital as Nor Aidora had testified the DNA which she analysed from samples retrieved from a mineral water bottle, towel and toothbrush were attributed to a "Male Y".

Yesterday, the defence managed to raise some doubts on the condition and service of the DNA equipment used in analysing the samples retrieved from sodomy complainant Mohd Saiful Bukhari Azlan.

The court yesterday also heard a police officer ASP Fauziah Che Mat testimony on seven individuals and cars that were seen going in and out of the Desa Damansara condominium on June 26, 2008.

Those identified includes Anwar and Saiful.

8.39am: Anwar arrives with PKR president Wan Azizah Wan Ismail. He is talking to the German embassy officials at the public gallery.

8.55am: Hearing begins with Justice Mohamad Zabidin Mohd Diah presiding.

9.00am: Ram Karpal Singh is cross-examining. Nor Aidora says she had testified in 15 cases including criminal and syariah cases.

The witness says she had also testified in three paternity cases. Most recently, she appeared at as a witness in a trial in Malacca.

9.04am: Witness says the Genetic Analyser 3130 XL manufactured by Applied Biosystem was used to perform the DNA analysis in this case.

9.09am: Statistical analysis is important, says the witness, to give weight to evidence.

NONE9.11am: Nor Aidora says statistical data is used if there was a match.

She says in this case she used the statistical data.

9.15am: PKR secretary-general Saifuddin Nasution is spotted in the public gallery.

9.17am: The witness says her chemist report is meant to be read together with Dr Seah Lay Hong's report.

Nor Aidora says her office is about 5 metres away from Seah's office.

9.19am: She says on July 17, 2008 she received the items from DSP Jude Pereira after 6pm. She said normally she left work at 6pm but her the chemistry department's director-general asked her to handle this case.

9.26am: Nor Aidora says her section head Lim Tong Boon would normally assign her work, but the order to handle the case came directly from the DG.

9.30pm: Solicitor-general II Mohd Yusof Zainal Abiden objects to a question by Ram, alleging that the defence counsel is trying to put words in Nor Aidora's mouth.

Ram retorts that his question is relevant. Justice Zabidin asks him to continue.

Nor Aidora has the court in stitches when she says, "I know you are angry, but do not be angry with me."

To a question by Ram, she says her section head would not give instructions but she would follow what is required by the POL 31 form.

The witness says normally the police will come to the DNA counter, and the section head will assign cases to the chemist whom he deemed fit.

9.40am: Nor Aidora says her DG called the section head at about lunch that day and asked her to handle this "big and high profile case".

Ram: Normally your DG would sit at the counter to give the case?

Nor Aidora: No, he would be in the office in the main building.

Ram: He must have knowledge of this case?

Nor Aidora: I do not know, as the DG had discussed matters with the head of the forensic division and her section head. They decided to give this "high profile" case to me. I do not know what are the samples, but was told to wait for them.

10.00am: The witness says she had not published any papers in journals. The question arose when Ram questioned her curriculum vitae.

Nor Aidora also says Seah had already left for the United States when she received the case on July 17, 2008.

10.09am: She says she obtained a perfect DNA sample in this case. But she admits she did not do test for degradation.

But Ram continues to ask if there was degradation to which Nor Aidora replies, "Yes."

There is an exchange between Yusof and Ram when the counsel continues with this line of questioning.

NONE10.45am: Court resumes after a short adjournment. Balik Pulau MP Yusmadi Yusoff and Lembah Pantai MP Nurul Izzah Anwar is spotted in the public gallery.

11.00am: Nor Aidora says she found DNA in 10 of the samples retrieved from the toothbrush, towel and mineral water bottle.

11.07am: She says that the DNA samples were obtained through trace sampling.

11.38pm: The witness says if there are three alleles, there could be a possibility of the presence of DNA of two persons.

For journalists, it is difficult to establish as Nor Aidora's report has yet to be classified as an exhibit. If it is an exhibit, it will become a public document.

12.00pm: Nor Aidora says the police instructed her to do DNA profiling in this case.

However, as to how she were to trace or detect samples it is up to her to conduct trace DNA procedures.

12.03pm: Court adjourns to 3pm.

2.50pm: Anwar is already in court. He is having a chat with cartoonist Zunar in the public gallery.

3.04pm: Court is now back in session.

3.08pm: Nor Aidura, when asked by Ram, maintains that the DNA she tested came from a single contributor.

Earlier, it was suggested the detection of three alleles from the towel shows it came from two individuals.

3.14pm: The witness disagrees that the sample has mixed DNA as there are four different loci.

3.22pm: Defence lawyer Karpal is wheeled into court. There are about 50 people in the public gallery.

3.33pm: Ram points out that "Male Y" does not have 18 allele.

Yes, Nor Aidora says.

Ram: Could your sample be contaminated as you recorded the 18 allele?

Nor Aidora: No.

3.38pm: Ram says she did not exclude that the 18 allele had come from police officer or investigating officer Jude Pereira from D3 (the towel)

Nor Aidora agrees.

The defence ends its questioning. DPP Noorin Badaruddin re-examines Nor Aidora.

3.50pm: On re-examination, Nor Aidora says the sample was not a mixed profile but came from a single person.

3.54pm: She says she received the Pol 31 from Jude Blacious and not from Lim.

3.56pm: Nor Aidora, in replying to question from DPP Noorin, says that there is no need to do degradation test as she had obtained perfect DNA sample.

4.03pm: DPP Noorin finishes his re-examination of Nor Aidora.

4.06pm: Court adjourns. Nor Aidora's report is still not marked as exhibit.

The hearing will continue at 8.30am on Monday with the cross-examination of ASP Fauziah Che Mat.
