The Kerala High Court on Tuesday refused to grant Opposition leader VS Achuthanandan’s plea for a CBI probe into the infamous ice cream parlour sex scandal in which Industries Minister PK Kunhalikutty of the Muslim League was allegedly involved. The court announced that it would supervise the investigation currently being carried out by a special Kerala Police team.
In an interim order on the petition filed by Achuthanandan, the court said it would consider the case again on December 22 to decide on its future course on the basis of the investigation report the police would submit. The Advocate General, who did not oppose the court’s decision, said the probe could be completed within 90 days.
Achuthanandan had filed the petition seeking a CBI probe into the 15-year-old scandal saying that the police probe was being sabotaged by the Congress-led UDF Government in which Kunhalikutty was a Minister. His close relative and former aide KA Rauf had “revealed” that he had derailed the earlier probes using money and political power.
A division bench headed by Chief Justice J Chelameswar said that the petitioner’s request for CBI probe was based on general allegations and unsupported by facts. It also said that the petitioner’s anxieties were mainly about the progress of the current investigation, adding that the court would now monitor the probe’s progress on a regular basis.
The division bench said that the petitioner who had asked for a CBI probe into the case should have supplemented his request with evidences and facts, which were missing. It added that it did not intend to circumvent legal procedures. The court would now take a final decision on the matter on the basis of the probe report on December 22.
Achuthanandan’s counsel pointed out that the current probe team had not yet questioned Kunhalikutty despite the strong allegations against him. He said that a former advocate general and an ex-additional advocate general had been accused of involvement in the bid to sabotage the probe but they too had not been quizzed by the police.
Opposing the Opposition leader’s demand, Advocate General KP Dandapani argued that the investigation was being handled by the same police team constituted by the petitioner when he was Chief Minister. There was no reason for the petitioner to suspect the officials, he said. The police had earlier handed over to the court the case diary and the probe progress report.
Responding to the interim order, Achuthanandan said the court decided to supervise the investigation directly because it was convinced that efforts were being made to sabotage the probe. But Kunhalikutty’s Muslim League said the verdict reflected the court’s conviction that the probe was progressing on the right direction.
The former LDF government headed by Achuthanandan had in February last constituted a special police team to probe the ice cream parlour sex scandal after Rauf “revealed” that Kunhalikutty had derailed the case by making the victims and witnesses of the scandal change their earlier statements against him using bribes and threats.
Rauf had also said that Kunhalikutty had earned favorable verdicts in cases related to the scandal by giving millions of rupees as bribe to two former judges. The Minister is accused of sexually abusing Rejina, then a minor girl based at an ice cream parlour in Kozhikode, back in 1996. He had resigned as minister in 2004 after Rejina made the allegation through TV channels.

Cerita murtad dah senyap. Cerita korek pasir dah hilang. Cerita bogel bukit lanjan dah hilang. Cerita komunispun dah suam suam. Cerita hududpun dah hampir tamat. Lepas ni kes Guan Eng pun mesti hilang jugalah.
Kalau macam ni perangai orang melayu, orang kafir akan terus menerus membuat taiklah. Orang kafir tahu yang orang melayu ni lemau. Hari ni cakap, esok lupa. Orang kafir tahu yang orang melayu ni pengecut. Tak berani hentak betul betul.
Kalau betul berani, kalau betul benci, perg! ilah cam pak Guan Eng dari atas bangunan KOMTAR. Campak ke bawah biar dia mati. Itu baru betul bertindak. Itu baru berani.
