RCI to look into cause of Teoh's death

Public pressure prevails as the government agrees into include the cause of death into the terms of reference.

A Royal Commission of Inquiry has been formed to look into the cause and circumstances of the death of DAP political aide Teoh Beng Hock.

This is one of two wide terms of reference announced by Prime Minister Najib Abdul Razak in a statement today.

The second term of reference states that the commission must conduct an investigation as to whether there was any improper conduct by the Malaysian Anti-Corruption Commission (MACC) when questioning Teoh on July 15, 2009.

The commission is also duty-bound to make recommendations to improve MACC practices if necessary.

NONEFederal Court judge James Foong will lead the five-member panel, also comprising of

- Former Federal Court judge Abdul Kadir Sulaiman

- Court of Appeal judge T Selventhiranathan

- Forensic pathologist Dr Bhupinder Singh and

- Psychiatric consultant and Cyberjaya Medical Science College University dean Dr Mohamed Hatta Shaharom.

The commission has three months to complete its investigations from its date of appointment, which was not given in the statement.

Previously, Najib announced that the commission will only look into whether the MACC had violated Teoh's human rights.

However, he has come under significant pressure to expand the terms of reference because the inquest into Teoh's death delivered an open verdict.

University of London graduate

Foong, 65, is a graduate from the University of London and was called to the English Bar by the Inner Temple. He engaged in private practice from 1971 and 1990.

In 1990, he was appointed as a judicial commissioner and was confirmed a High Court judge in 1992. He has served in Kuala Lumpur, Johor Bahru, Shah Alam, and Ipoh.

He was appointed to the Court of Appeal in 2005 and was made a Federal Court judge in 2009. He is also the managing judge of the civil division for Kuala Lumpur and Selangor.

The statement also named the Saripuddin Kasim as the secretary of the commission.

NONEThree officers from the Attorney-General Chambers will be assisting the panel in the inquest namely Amarjeet Singh, Awang Armadajaya Awang Mahmud and Kwan Li Sa.

Amarjeet is the deputy head II in the Civil Division of the Attorney General Chambers.

Teoh, an aide to Selangor exco member Ean Yong Hian Wah, was found dead after undergoing interrogation by the Selangor MACC at Plaza Masalam.

An inquest decision earlier this month returned an open verdict, but ruled Teoh's neck injury was caused pre-fall but there was "no evidence to confirm that this injury facilitated or contributed to Teoh's demise".
